Terms and Conditions

Welcome to Weather Revolution (operated by Weather Revolution, "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website (www.weatherevolution.ch), mobile applications, weather station data feeds, APIs, and related services (collectively, the "Service"). Please read these Terms carefully before using the Service.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service. We may modify these Terms at any time, and such modifications will be effective immediately upon posting the modified Terms on the Service. You agree to review the Terms periodically to be aware of such modifications, and your continued access or use of the Service constitutes your conclusive acceptance of the modified Terms.

2. Description of Service

Weather Revolution provides hyper-local weather data, forecasts, and related information derived from a network of proprietary and partner weather stations. The Service includes:

  • Access to real-time and historical weather data via our website and applications.
  • Weather forecasts and analytics.
  • Installation, maintenance, and data provision services for hosted weather stations (subject to separate agreements).
  • APIs for developers (subject to specific API terms).
  • Notifications and alerts based on user preferences and weather conditions.

3. User Accounts and Registration

To access certain features of the Service, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during the registration process.
  • Maintain and promptly update your account information.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to the Service or your account.

You are responsible for all activities that occur under your account.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service:

  • In any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from Switzerland, the EU, the US or other countries).
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Weather Revolution, a Weather Revolution employee, another user, or any other person or entity.
  • To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm Weather Revolution or users of the Service or expose them to liability.
  • To scrape, data mine, or otherwise extract data from the Service without our express written permission.

5. Weather Station Installation and Hosting (If Applicable)

If you engage Weather Revolution to install and host a weather station ("Hosted Station"), specific terms related to site access, installation requirements, maintenance responsibilities, data ownership, and service fees will be outlined in a separate Hosting Agreement. You grant Weather Revolution necessary access to the designated property for installation, maintenance, and removal of the Hosted Station equipment. Data generated by Hosted Stations contributes to the overall Weather Revolution network, and specific data usage rights will be defined in the Hosting Agreement.

6. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Weather Revolution, its licensors, or other providers of such material and are protected by Swiss and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the Service for your personal, non-commercial use only, or for internal business purposes if you have a commercial subscription. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
  • You may store files that are automatically cached by your Web browser for display enhancement purposes.
  • You may print or download one copy of a reasonable number of pages of the website for your own personal, non-commercial use and not for further reproduction, publication, or distribution.
  • If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.
  • If we provide social media features with certain content, you may take such actions as are enabled by such features.

7. Data Accuracy and Disclaimer

While Weather Revolution strives to provide accurate and timely weather data and forecasts, weather forecasting and measurement are inherently complex and subject to various factors beyond our control (e.g., equipment malfunction, transmission errors, rapidly changing atmospheric conditions).

THE SERVICE AND THE DATA PROVIDED ARE OFFERED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TIMELINESS, OR NON-INFRINGEMENT. WEATHER REVOLUTION DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

You acknowledge that any reliance on the Service or data provided is solely at your own risk. Weather Revolution shall not be liable for any decisions made or actions taken based on the information provided through the Service. Always use multiple sources and exercise caution when making decisions based on weather information, especially for safety-critical activities.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WEATHER REVOLUTION, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

This limitation of liability does not affect any liability that cannot be excluded or limited under applicable law (such as liability for death or personal injury caused by our gross negligence or willful misconduct, or fraud).

9. Indemnification

You agree to defend, indemnify, and hold harmless Weather Revolution, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, any use of the Service's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Service.

10. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the substantive laws of Switzerland, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the competent courts of Lugano, Canton Ticino, Switzerland, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Termination

We may terminate or suspend your access to all or part of the Service, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Miscellaneous

Entire Agreement: These Terms and our Privacy Policy constitute the sole and entire agreement between you and Weather Revolution regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

Waiver and Severability: No waiver by Weather Revolution of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Weather Revolution to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
